Terms of Services

Welcome to DAR. By accessing or using the DAR website dar.re.kr (the “Site”) made available by Data and Research (“DAR”, “we”, “us” or “our”), the user (“you,” “your,”) understand and agree to be bound by our Terms of Service (“Terms”). Please do not access or use the Site, the Site contents or the Services if you do not accept all of the Terms.

  1. The Service

DAR provides contents and services to users, including data, research reports, and translation services (the “Services”) in accordance with these Terms.

DAR strives to produce fair and accurate work product, based on objective, integral and complete information and data as possible. Users can access most of the contents in the Site without a membership subscription. However, access to certain data, detailed descriptions and in-depth information, and translation services, among other things, are restricted to paying users.

Users may be required to enter into separate agreement(s), with DAR for any content or Service (each an “Additional Agreement”). If there is any conflict or inconsistency between the Terms and an Additional Agreement, the additional agreement shall take precedence over the conflicting or inconsistent Terms only.

  1. Duties of Users

You agree that you will comply with all applicable laws and regulations when accessing or using the Site, the contents and the Services.

DAR does not put aside any capacity to keep or reserve the contents or the services purchased by an individual user. It means that once downloaded by a user, the purchased content or work product is not available to access on the Site without paying a charge. It is the user’s duty to keep the downloaded or purchased contents or outcomes of the Services properly for one’s own use.

You agree that you will not copy, re-publish, sell, distribute or resell any content or any information, files, databases, etc. available on or through the Site for the purposes of operating a business that competes with DAR, or otherwise commercially exploits the Site content without permission or agreement from DAR. Any content or materials on the Site purchased for any purpose should include a clearly stated reference to DAR.

DAR kindly asks users to utilize the Site contents only as a reference for insight. DAR will not be responsible for the consequences from any decisions made by users based on the Site contents.

You agree not to undertake or be involved in any action or scheme to undermine the integrity of the data, systems or networks of DAR, or to acquire or seek to acquire unauthorized access to such data, systems, or networks.

  1. Suspension of Service

The Services may be suspended for the following reasons, in which case we will provide you with notice of the suspension. During the time services are suspended, we have no obligation to provide you with any Services, and we will not be responsible or liable for any liabilities incurred by you or any third party resulting from such suspension, except in the case of our willful misconduct or gross negligence. Our Services may be suspended in any of the following events:

  1. Our computers or other telecommunication equipment fails or requires maintenance, inspection, or replacement, or interruptions in telecommunications;
  2. Hacking or other security breach, telecommunication failure, abnormal user activity, our responses to unexpected Service instabilities;
  3. To protect our community or Services, or if you create risk or legal exposure for us, violate these Terms or our policies, if you repeatedly infringe other people’s intellectual property rights, or where we are permitted or required to do so by law;
  4. Force majeure, emergency, power outage, equipment failure, congestion in user traffic, or other situations where it is impractical to provide Services;
  5. When our substantial management needs, such as financial difficulties, requires it; or
  6. Any other situation similar to the above.

DAR reserves the right to remove, modify or delete any comments that users post or display on the Site in any of the following cases;

  • Spamming, phishing, advertising, promote
  • False, misleading or deceptive information, defamatory, libelous, threatening or harassing, obscene, objectionable, offensive, sexually explicit or harmful on others,
  • Information that is discriminatory or promotes discrimination based on race, sex, religious, nationality, disability, sexual orientation or age
  • unagreed privacy revelation, infringement or violation on any of copyright, patent, trademark, trade name, trade secrets or any other personal or proprietary rights of any third party, unrelated contents to the pertaining section, or other inappropriate posts or comments

  1. Intellectual Property Rights

DAR is the sole owner or lawful licensor of all the rights and interests in the Site, the Site content and the Services. The Site, Site contents and the Services and other intellectual property rights are protected under worldwide copyright and other laws. All title, ownership and intellectual property rights in the Site and Site content shall remain with DAR as the case may be. All rights not otherwise claimed under the any other additional terms or agreements are hereby reserved.

Providing our Services requires collecting and using your information. Our Privacy Policy explains how we collect, use, and share your information. It also explains the many ways you can control your information. You must agree to the Privacy Policy to use the Service. We do not sell users’ personal information. All notices or demands to or upon a user shall be effective if either delivered personally, sent by courier, certified mail, by facsimile or email to the last-known correspondence, fax or email address provided by the user to DAR, or by posting such notice or demand on an area of the site that is publicly accessible without a charge. Notice to a user shall be deemed to be received by such user if and when:

a) DAR is able to demonstrate that communication, whether in physical or electronic form, has been sent to such user, or
b) immediately upon posting such notice on an area of the Site that is publicly accessible without charge.

You agree that all agreements, notices, demands, disclosures and other communications that DAR sends to you electronically will satisfy any legal requirement that such communication should be in writing.

  1. Miscellaneous
  1. If any aspect of this agreement is unenforceable, the rest will remain in effect. Any amendment or waiver to our agreement must be in writing and signed by us. If we fail to enforce any aspect of this agreement, it will not be a waiver. We reserve all rights not expressly granted to you.
  2. This agreement does not give rights to any third parties. You cannot transfer your rights or obligations under this agreement without our consent. Our rights and obligations can be assigned to others. For example, this could occur if our ownership changes (as in a merger, acquisition, or sale of assets) or by law.
  3. Our Service is provided “as is,” and we cannot guarantee it will be safe and secure or will work perfectly all the time. TO THE EXTENT PERMITTED BY LAW, WE ALSO DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
  4. We also do not control what people and others do or say, and we are not responsible for their (or your) actions or conduct (whether online or offline) or content (including unlawful or objectionable content). We also are not responsible for services and features offered by other people or companies, even if you access them through our Service.
  5. Our responsibility or liability for anything that happens on the Service is limited as much as the law will allow. If there is an issue with our Service, we cannot know what all the possible impacts might be. You agree that we will not be responsible or liable for any lost profits, revenues, information, or data, or consequential, special, indirect, exemplary, punitive, or incidental damages arising out of or related to these Terms, even if we know they are possible. This includes when we delete your content, information, or account.
  6. These Terms and the rights and obligations of the parties shall be governed by and construed in accordance with the laws of the Republic of Korea, without giving effect to conflict of laws provisions. In case of any dispute or claim between the parties arising out of or related to this Agreement, the Seoul Central District Court shall have exclusive jurisdiction over such dispute or claim.

  1. Updating the Terms

We reserve the right, in our sole discretion, to provide service updates and amendments to the Terms of Service (“Updated Terms”) from time to time. You will be notified of any revisions to these Terms, including any newly added, deleted or updated information, the effective date of the amendment, and the reason for the amendment through a notice at least 7 days prior to any amendments. However, notices on important or unfavorable amendments will be made at least 30 days prior to the effective date of the amendment. After giving notice of the amendment, we will confirm whether or not you have consented to the Updated Terms. Your failure to respond within the aforementioned time period (as applicable), will be deemed as an acceptance of the Updated Terms.

This Terms of Service shall apply from March 4, 2020.
